The claim is for an entitlement to profits derived from their likeness and image, a/k/a publicity rights. I suggested that the NCAA should be nervous about that development in the litigation, to add to their considerable concern over potential class action status for all similarly-situated student athletes. Apparently the concern was sufficient this week for the NCAA to issue a press release that it would not renew its agreement with the video game maker – EA Sports that used the likeness of players without player consent in conjunction with NCAA logos.
