So Manning did have the right to be spared cruel and unusual punishment under the Eighth Amendment of the US constitution and to avoid pre-trial punishment under Article 13 of the Uniform Code of Military Justice. It's just that the judge Denise Lind did not accept that violations of those rights had taken place - hence the meagre 117 reduction from his sentence that she allowed on the basis of his treatment in Quantico. It's possible, I suppose, that he might be able to appeal that decision after his sentence is given out, but we'll have a while to go before we see if that happens.
